Fixed penalty notices issued in York

Fly posting, fly tipping, littering and dog fouling

As they promised, the York council has now updated its “open data” web site to include details of the number of fixed penalty notices (FPNs) issued.

An FOI request was prompted by a large number of fly posting incidents in west York advertising the arrival of a Fair.

The published stats only go up to June at present but they reveal a downward trend on FPNs issued for fly posting.

In total 36 were issued during the first 6 months of the year.

Fly tipping is also a continuing problem in some areas. Here the figures reveal that no FPNs were issued during the first part of this year.

It was similar picture for dog fouling with no FPNs issued between January and June.

Only 1 FPN was issued for littering.

Let’s start with an example of good practice.

The York Council was asked, via the “What do they know” web site, for information on the numbers of Fixed Penalty Notices (FPN) issued for Fly tipping, Fly posting and graffiti.  Similar information for other offences was already posted by the Authority on its open data website.

A response was provided within a few days with the Council agreeing to add information for fly tipping and flyposting to the Open Data website. This means that information will be updated regularly. The question about flyposting was prompted by an epidemic of “Fair” posters which appeared on the west of the City.

The York Council says that it does not hold statistics on the number of prosecutions for graffiti which have been undertaken. It points to the police as a potential source of information claiming that the force could extract graffiti cases from the more general “criminal damage” heading.

We have had less luck with North Yorkshire Police.

We have been attempting for over a year now to get speed and casualty information from them in an attempt to understand how it drives the deployment of their speed camera vans.

We wanted to see trend information for sites regularly monitored by the vans. We expected that management information would demonstrate that the mean/average speeds recorded showed a downward trend, that the number of vehicles exceeding the prevailing limit would be falling and that accident levels on the monitored roads would also be showing a downward trend.

The most recent report from the police indicates that they don’t hold any of this information nor have they tried to correlate the stats provided by NYFR when they deploy their speed monitoring equipment on road around the county.

We find it astonishing that objective results figures of this sort are not being regularly monitored by those managing the, very expensive, camera van programme.

Nor can the York Council bask in any glory. In February, we asked which businesses had not paid their NNDR (Rates) bills in each of the last 3 years.

The request was turned down on the, entirely specious, grounds that it might influence the result of a by election which was taking place last February. Eventually the Information Commissioner ruled that the information had to be released and it duly was on 26th September.

It revealed that the Council were chasing £576,803.04 in arrears that had accumulated over the last 3 years.

The response did not reveal the names of the businesses involved.

We asked for that information on 1st October but, as yet, we have had no reply.

Only 8 fines levied for dog fouling in York during last 3 years

The latest figures published on the Councils open data web site say that only 8 fixed penalty tickets have been issued for dog fouling since April 2015.

No penalty notices have been issued at all since June last year.

Similarly, no Community Protection Notices (see right) for dog fouling have been issued since 2015

The York Council receives around 2000 requests for action each year on cleansing issues which includes dog fouling. It no longer publishes the number of complaints it receives about full poop scoop bins but it used to be around 20 a month..

A contract was let in April for the replacement of ageing “poop scoop” bins in the City.

Several campaigns have been run to highlight the risks associated with dog fouling. These included, in some areas like Foxwood, displaying eye catching posters while in others local residents highlighted “poop” on footpaths with spray markers.

Whether the problem has got better, or worse over recent months is difficult to assess.

Issues can be traced back to 2012 when the, then Labour controlled, Council scrapped the “dog warden” service. At the same time, they reduced the number of litter and dog bins in the City.

The fine weather is likely to mean increased work for York’s street cleaning teams.

Last August the number of reports about street cleansing issues (which includes dog fouling) hit an all time record high.

The Council hasn’t updated its open data page since then, but anecdotal evidence suggests that – at least in some suburbs – problems  continue at a high level.

Lowfields trench digging mystery explained

A JCB has been digging up part of the Lowfields playing field this week.

Anxious residents – who are keen to see the playing fields retained – have been told that this is work being undertaken by the York Archaeological Trust.

An official has contacted local Councillor Andrew Waller to say,

“As you are aware as part of the planning application we are required to undertake a number of site surveys in support of the planning application that we wish to make to develop the site. The trench work that is currently being undertaken are follow up works to an earlier geophysical survey that was undertaken in June 2017 in support of the planning application.

York Archaeological Trust (YAT) have been commissioned to undertake an archaeological evaluation of the site, which as you are aware is common practice in York. The Trust will be on the site until Monday 4th September 2017.

On completion of the investigative works, YAT will back fill the trenches with the stockpiled top & sub soil removed during the excavation & compact the earth”.

Fake phone cover pedlar handed suspended sentence and fined £1,280

A street pedlar who sold counterfeit phone and tablet covers in York city centre has been given a 12 week prison sentence, suspended for one year, with the requirement he also undertakes 300 hours unpaid work. Mr Faye was also fined a total of £1,280 by York Magistrates today (12 April 2017).

The fake brands included Dior and Apple and were among thousands of items discovered stockpiled in the pedlar’s basement and a storage unit by City of York Council trading standards officers.

60% of York residents say road maintenance is “poor”

With the York Council’s ruling Executive due to discuss it’s first quarter performance later today, a new survey has revealed that many residents are unhappy with public service standards in the City.

Road repairs (60% rated “poor”) and footpath  repairs (57%)  top the list of woes, but there is also criticism of litter bin provision and car parking arrangements in some sub-urban estates.

Best rated service was recycling (92% rated good or satisfactory), with refuse collection also rated positively (89%).

The Council’s investment in new street lighting seems to be impressing people  with 87% now rating it as good or satisfactory.

However there is little evidence that the Council’s proclaimed priority – investing in street level service quality – is having a positive effect.

Dissatisfaction with roads and footpaths is at an all time high.

Councillors today will be given a different set of figures to consider. Their “key performance indicators” are not included on the Executive agenda but can be accessed via the”open data”  web site.

This is in itself a step forward from previous years when data was often hidden from residents.

However a closer look at the stats reveals that, not only are most quarter one figures unavailable, but also many of the out-turn figures for 2015/16 haven’t been updated.

No improvement targets are identified.

Quite what “performance”  – other than a bland anecdotal commentary – Councillors will therefore be considering later today is a mystery.

The York Council must now put more emphasis on customer satisfaction. Publishing the results of quarterly residents “talkabout” panel views would be a start.

The key message though, as the Council begins to construct its budget priorities for next year, is that  residents want to see more invested in repairing our roads and footpaths. 

 

11% increase in crime in York

“Hate crime” figures up from 108 in 2014/15 to 141 in 2015/16

Performance figures released by the Council confirm that there has been a significant increase in crime levels in the City.

 During 2015/16, there were a reported 12,018 crimes for the York area, a total of 1,211 more than those reported during 2014/15.

Increases have been seen in violent crime, criminal damage and the burglary of non-dwelling properties.

Detailed crime figures reveal that the number of complaints about “hate” crimes (such as racially motivated abuse) were on the increase even before the recent referendum result served to highlight the issue even more.

Residents will have to search if they want to find KPI data for public services.

The figures are not being reported to the Executive meeting taking place tomorrow.

However, they are available by clicking here.

Unfortunately many of the tables do not include comprehensive target information and most of the customer satisfaction measures haven’t been updated since 2013.

York Libraries and Theatre Royal publish progress reports

Reports from two key leisure operators in York will be debated by the Council next week.

They cover the activities of the York Explore Library team and the Theatre Royal.

The Libraries now operate as an independent “community benefit society”. They receive funding of over £2 million a year from York taxpayers so it is disappointing that the report says little about the organisations financial position. Nor are KPIs tabulated.  However, local libraries have maintained, and enhanced, their reputations over the last year. They are more outward looking with several – including Acomb – seeking to establish “Friends” support groups. They are also meeting the challenge of a, still expanding, technology sector.

The Theatre Royal – which is an independent trust – has had a turbulent year with performances moved to the Railway Museum while the St Leonard’s Place building was completely modernised. The work ran 6 months behind schedule which was a major challenge for the theatre’s management. Early reactions to the recently reopened theatre have been generally positive. With the Council having paid their annual grant up front to help pay for the costs of the refurbishment the theatre faces a testing few years on the financial front. The Theatre Royal is an important part of York’s cultural heritage and most residents will wish it well as it seeks to re-establish itself.

The latest performance figures from the York Council provide a lot more information about public service standards in the City. It is a welcome improvement from the “dark ages” between 2011 and 2015 when little was revealed and Freedom of Information requests flourished

The Council is reporting a big over-spend on the costs of looking after children from broken homes. Car parking income is already £282,000 below budgeted levels, and the Council has, of course, received no income from ANPR enforcement on Coppergate.

One worrying trend is on crime where “significant increases are forecast in the violent crime, criminal damage and burglary of non-dwellings”. With elections for the role of Police and Crime Commissioner coming up in May, candidates can expect to be questioned closely on their plans to reverse crime trends in the City.

As you would expect, performance in other areas varies. No one expects perfection – just a solid response to any evidence of declining standards.

The only department that still hasn’t adjusted to the new, more open, culture appears to be the Housing department. The Housing Revenue Account looks like it will underspend by £480,000 this year – yet many estate regeneration projects remain on the shelf.

Housing KPIs lack information about contact volumes, complaint levels. repair numbers and customer satisfaction levels.  There is no exception reporting. No “longest outstanding issue” figures are provided.

Housing have also produced a new “business plan” which singularly fails to identify any administrative savings despite a heavy investment in technology. The lamentable condition of many estates – particularly  communal spaces and in garage areas  – together with growing issues like the lack of off street car parking, is largely ignored.

The Council’s Executive when it meets next week should send the housing documents back for a rethink.
